No Surprise: In the Digital Era, Territorial Licensing / Old Model Rights Practices Are Problematic → mbvmusic.com

The Labels will wage war on themselves.

Sony Music France wrote to tell me to take down a Passion Pit song I posted yesterday (“remove those copyrighted files”).

I am not taking it down.

The MP3 was introduced to the internet yesterday by the band’s US label, Frenchkiss, who premiered it on Pitchfork and then urged people to “go download it.”

This is not an issue of “copyrighted materials being illegally posted;” this is an issue of outdated, unworkable ‘old-model’ rights practices, and an issue of 2 labels with a common interest not communicating with one another.

Yet another chapter in the music industry follies: Global rights.

“…the performance had to be very intense. Like this is the most important thing that’s ever happened. And then the records each became more important. And the fact that there were these record launches with every LP created this weird narrative about the importance of this group. Anyways, the point is, with the end of the record album, bands can’t really have the same pretenses anymore. It’s being stripped away, which is really tragic, but it’s also maybe great. Who knows? Rock ‘n roll bands had their day, but they didn’t really succeed in blowing up—they weren’t as revolutionary as they purported. Kanye West hasn’t really done anything worthwhile—except maybe musically, I haven’t heard him. But he hasn’t overthrown the government.” —

Ian Svenonius (Nation of Ulysses, Make*Up, Weird War, Chain & The Gang)
